Smart-Kids Competition Terms & Conditions
1.The rules of the Smart-Kids Competition (“Promotional Competition”) are subject to section 36 of the Consumer Protection Act (68 of 2008) and wherever possible, these rules have been aligned with this Act.
2.By entering this Promotional Competition in the manner described below, each person accepts and agrees that they will be bound by these rules.
3.Duration: This Promotional Competition starts on 24 April 2013 and closes at midnight on 30 April 2013. Any entries received after the closing date will be invalid and not qualify for the Prize.
4.Promoter: The promoter of the Promotional Competition is Pearson Education South Africa (Pty) Ltd (the “Promoter”)
5.Prize: By entering this Promotional Competition, participants stand the chance to win one of 10 Smart-Kids books (the “Prizes”).
6.Participants: The Promotional Competition is open to all residents of the Republic of South Africa (the “Participants”). A director, member, trading partner, employee or agent of, or consultant to the Promoter or any other person who directly or indirectly controls or is controlled by the Promoter; or a supplier of goods or services in connection with this Promotional Competition, will not be allowed to enter this Promotional Competition and will not be eligible for any of the Prizes.
7.To enter the Promotional Competition and stand a chance to win one of the Prizes, the Participant must fill in the Promotional Competition entry form, which form can be found at www.smart-Kids.co.za or www.slimkoppe.co.za.
8.Participants may enter this Promotional Competition only once by sending the completed Promotional Competition entry form to the Promoter by means of completing the competition entry form on www.smart-Kids.co.za or www.slimkoppe.co.za.
9.Participants must provide a valid mobile number and e-mail address with their Promotional Competition entry form and only 1 (one) Prize will be awarded per participating mobile number.
10.Each entry is made with the understanding that Participants will be charged and liable for the standard rates that apply to their own mobile phone service provider or e-mail account provider or post office.
11.Participants entering by means of a mobile phone must either be the legal owner of the mobile phone used or have the permission of his/her parent or guardian to use the phone to enter the Promotional Competition.
12.The Prizes are non-transferable and may not be exchanged for cash. The Promoter reserves the right to substitute the prize for another prize of like value at any time and for any reason.
13.The successful Participants will be selected by means of a draw and the Promoter’s decision will be final and not subject to any review or discussion.
14.The successful Participants of the Prizes will be contacted on their mobile phones and notified by e-mail.
15.The Prize(s) will be forfeited if the successful Participant(s) fails to redeem the Prize(s) within 2 weeks /14 days of email notification from the Promoter, in which case the Promoter may select, by means of another draw, another successful Participant, or the Promoter may in its sole discretion decline to appoint another successful Participant.
16.The successful Participants will be notified by 8 May 2013 and Pearson will send the Prizes by registered mail to the successful Participants to reach them by 31 May 2013. Despite this, successful Participants should be aware that Prizes may take 4 – 6 weeks to reach them from the time that they are informed that they are successful Participants of this Promotional Competition and that the delivery time is influenced by the proximity of the delivery address provided.
17.Neither the Promoter (including its directors, employees, agents and consultants), and their respective advertising, media and Public Relations agencies, nor their trading partners shall be liable in any way whatsoever for any loss, damage or costs, howsoever arising, suffered by any Participant.
18.The successful Participants may be required to take part in various forms of publicity, which may include the taking and publishing of photographs. Participation in the Promotional Competition is conditional upon the Participant’s consent to take part in such publicity, which consent will be deemed to have been given once the Participant submits his/her Promotional completion entry from. Successful Participants will not be entitled to any payment or other form of remuneration for any publicity associated with this Promotional Competition or with the Promoter’s business. All and any materials, including publicity materials, related to this Promotional Competition and/or the Promoter’s business will be the sole property of the Promoter.
19.The Promoter reserves the right to terminate or temporarily suspend this Promotional Competition, at its own cost, if technical or other difficulties may compromise its integrity. In this case, the Promoter, its directors, employees, and agents shall not be held responsible for the termination or temporary suspension of the Promotional Competition and the same will apply to any difficulties experienced by Participants in submitting a Promotional competition entry form.
20.The Promoter reserves the right to alter these rules, including the Prizes, at its own discretion. Such altered rules and prizes shall become effective immediately after being altered or on such a date as may be determined and will be placed on the Promotional Competition website for Participants to view.
21.Participants accept that if they do not follow or adhere to these rules that they will be disqualified from the Promotional Competition.
22.This Promotional Competition is in no way sponsored, endorsed or administered by or associated with Facebook. Participants agree that any information that they submit with the Promotional Competition entry form is provided to the Promoter and not to Facebook or any other social media website. The information Participants provide will only be used by the Promoter for purposes that falls within the scope of this Promotional Competition and the business of the Promoter.
23.These rules are governed by the laws of the Republic of South Africa and Participants agree that this Promotional Competition is subject to the exclusive jurisdiction of the South African courts.
24.These rules, as amended from time to time, will be published on the website www.smart-kids.co.za and may be requested for the duration of, and for a limited period after, the Promotional Competition via e-mail from firstname.lastname@example.org.
